Overview - Capacity Clinic
No two decision makers are the same; no two decisions are often the same
There has been no assessment training or regulatory standards offered by any professional college or ministry to assess the decision-making capacity of a person who is:
-
signing/revoking a Will;
-
signing a contract (including selling/buying real estate or hiring a service provider)
-
giving a gift to someone
-
instructing counsel
-
getting married, divorced or reconciling etc.
As a result, capacity evaluators are almost exclusively operating part-time, without support/collaboration of other professionals and using informal engagement procedures which do not define expectations of the process or outcome - and there is no support from the broader assessment community.

HOW DO YOU KNOW IF AN EVALUATOR CAN INTERPRET THE INFORMATION OF THE ASSESSMENT? HOW CAN YOU DEFEND A CAPACITY ASSESSMENT THAT IS BASED ON LIMITED INTERACTIONS?
